Assembly Secretariat disallows resolutions on Art 370, detainees, reservation

Jammu, Mar 22: Jammu & Kashmir Legislative Assembly Secretariat has disallowed resolutions brought on issues like Article 370, detainees and reservation policy.
Sources said that the Assembly secretariat has disallowed resolutions on matters like Article 370, detainees and reservation.
The resolutions on Article 370 have been disallowed under the Rules of Procedure and Conduct of Business in the J&K Legislative Assembly.
“As per Rule 187,when a resolution has been moved, no resolution or amendment raising substantially the same question shall be moved within one year from the date of the moving of the earlier resolution,” the Rules state.
As already reported, PC president Sajad Gani Lone had submitted a resolution seeking restoration of Article and Article 35A.
They said the resolutions on matters of the Home department have also been disallowed because they are outside the purview of the UT Assembly. “The Home department falls outside the domain of the J&K Assembly under section 32 of J&K Reorganisation Act,” they said, adding that resolutions relating to detainees have also been disallowed because it is the domain of Home department.
According to sources, the resolutions brought on reservation and allied issues by legislators from the ruling party as well as the opposition have been disallowed because it is sub-judice in J&K High Court.
“As per sub-rule (5) of Rule 177 of the Rules of Procedure and Conduct of Business in J&K Assembly, the resolution shall not relate to any matter which is under adjudication by a court of law having jurisdiction in any part of India,” sources said.
They, however, added that bill(s) brought on the issue wouldn’t be affected by this Rule.
“This Rule doesn’t apply to bills brought on reservation issues,” they said.
According to sources, the resolutions would now be subjected to ballot procedure for taking up them in the House on April 7 and 9.
“The resolutions admitted by the LA secretariat would now go through ballot procedure on March 25 for determining their precedence. Seven resolutions each would be taken up in the House on April 7 and 9,” they said. (KNO)
