Srinagar, Apr 24: The Central Administrative Tribunal (CAT) Srinagar has expressed concern over continued non-compliance of its earlier judgment in a salary-related case and directed the personal appearance of a senior official to ensure implementation.
The direction came in a contempt petition filed by Ghulam Mustafa Mantoo against the General Administration Department, where the applicant alleged that the judgment passed in his favor had not been implemented despite being upheld by the High Court.
The tribunal noted that despite assurances from the government side to file compliance within a stipulated time, the response submitted was repetitive and did not address the core issue of implementing the order.
It observed that compliance of a court judgment is essential, stating that without execution, a judgment would remain “a simple piece of paper.”
During the hearing, counsel for the applicant submitted that the delay in compliance was causing hardship, including non-release of salary. The applicant had also provided an undertaking that any payment would remain subject to the outcome of related proceedings.
Taking note of what it described as continuous non-compliance over a prolonged period, the tribunal directed the personal appearance of the Registrar, Special Tribunal, J&K, on the next date of hearing scheduled for May 5, 2026.
The tribunal also remarked that summoning senior officials is not routine and is done only when necessary to ensure enforcement of court orders and uphold the rule of law. It emphasized that no individual or authority is above the law.
The case has been listed for further hearing, with directions issued to communicate the order to the concerned official. [KNT]
