Sajad Lone questions powers, privileges of J&K MLAs over constituency funds

Srinagar, Sep 24: Peoples Conference president and Handwara MLA Sajad Lone on Thursday questioned the powers and privileges of elected representatives in Jammu and Kashmir and raised concern over the alleged diversion of constituency development funds in the Legislative Assembly.
Lone asked Speaker Abdul Rahim Rather to clarify the rights and privileges available to MLAs under the Union Territory framework and whether an elected member has the authority to recommend development works in his or her constituency.
He alleged that constituency development funds were being diverted and that elected MLAs were being bypassed in favor of ministers belonging to the ruling party. The allegations were made by Lone during his address in the House and were not independently established in the proceedings available for this report.
Lone said opposition members from Kashmir had exercised restraint in their public conduct while seeking restoration of statehood, saying they were conscious that their statements could be used against the broader demand.
He questioned whether funds allocated for development belonged to a particular political party or to the people of Jammu and Kashmir.
Lone also urged the Speaker to safeguard the authority and dignity of elected members and sought clarity on the institutional remedy available to an MLA in case of an alleged breach of privilege.
“If they think they will walk over us, the question doesn’t arise,” Lone said during his address.
He said elected members could approach the Union Government or other constitutional authorities if necessary, but maintained that the Assembly should remain the primary institution for safeguarding the rights and privileges of its members. [KNT]
